Off-Campus Pass Criteria, Stipulations, Assumption of Risk, Waiver:

-Students must maintain a 2.0 GPA to retain Off-Campus Pass privileges

-A Student ID Card is required (with appropriate sticker) to leave campus each day

  • The Aeries Digital version will not be accepted at the gate when exiting campus

-Students are expected to efficiently depart and return according to their agreed upon schedule

-TUSD, nor its officers or employees, are liable for student off-campus conduct/safety/supervision

 

OFF-CAMPUS PASS ASSUMPTION OF RISK AND WAIVER OF LIABILITY

High School Students in good standing within the Tustin Unified School District may apply for an Off-Campus Pass for a variety of reasons. Going off campus on such a pass is a privilege that can be revoked at any time by school administration. There may also be scenarios where school administration decides to not allow passes on a given day for either safety or school business. Aside from Seniors with a five-period day ending at lunch time, Athletes/Artists may also encounter a scheduling scenario where a gap exists between their final academic class and a “late” practice time. An Off-Campus Pass may be issued in either of these scenarios.

Assumption of Risk: The undersigned hereby acknowledge and agree that they understand the nature of utilizing an Off-Campus Pass; that the Tustin Unified School District will not provide supervision beyond reasonable proximity of the campus for students utilizing Off-Campus Passes; that the student utilizing the pass is qualified, capable of caring for themselves, in good health, and able to safely and independently travel between school and their home; that there are certain inherent risks and dangers associated with utilizing an Off-Campus Pass; and that, except as expressly set forth herein, they knowingly and voluntarily accept, and assume responsibility for, each of these risks and dangers, and all other risks and dangers that could arise out of, or occur, while utilizing an Off-Campus Pass.

Release and Waiver: The undersigned hereby RELEASE, and WAIVE the Tustin Unified School District and its member institutions, or any of their officers and employees (collectively the “Releases”), from and for any liability resulting from any personal injury, accident, or illness (including death), and/or property loss, however caused, arising from, or in any way related to, Participant’s use of an Off-Campus Pass. In addition, the undersigned agree to INDEMNIFY and HOLD HARMLESS the “Releases” from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities including, but not limited to, attorney’s fees, arising from, or in any way related to, Participant’s utilization of an Off-Campus Pass.

Acknowledgment of Understanding: The undersigned have read this assumption of risk, release, waiver or liability and indemnity agreement, and have had the opportunity to ask questions about the same. The undersigned fully understand this assumption of risk, release, waiver of liability and indemnity agreement, that the undersigned are giving up substantial rights in connection therewith, and that its terms are contractual, and not a mere recital. The undersigned acknowledge that they are signing this agreement freely and voluntarily.
